INDUSTRY NEWS Pandemic Flu Preparedness Survey Results Released Today; Centers for Disease Control Offers Business Planning Checklist Today, the International Facility Management Association released the results from its pandemic flu preparedness survey taken of its membership. 39 percent of the membership were in the process of creating or updating a plan, while 35 percent said that such planning has not been considered. Only seven percent had plans completed or implemented. According to a statement issued by the White House last week, up to 40 percent of the workforce could be absent in the event of a major flu outbreak, therefore it recommended the need for all businesses to have a plan in place. The Centers for Disease Control offers a useful Business Pandemic Influenza Planning Checklist and related materials at www.cdc.gov/business. The so-called "bird flu," technically known as H5N1 Highly Pathogenic Avian Influenza, is a viral respiratory infection that afflicts some of the bird population overseas but has not, to date, directly mutated to infect humans. According to media reports, the only known human cases are due to individuals who have handled infected birds without wearing protective gear. While there has been no transmission of this disease from human to human, officials are concerned that over time the strain may mutate with other more common forms of influenza and thereby infect a large number of people. This evening at 8 PM eastern time, ABC TV is airing a made-for-TV movie (not a documentary) titled "Fatal Contact: Bird Flu in America." Although the network stresses that the film is a fictional work, it will offer a Viewer's Guide on the avian flu virus that has been prepared by the U.S. Department of Health and Human Services. FCC Publishes Final Regs for Junk Fax Last month, the Federal Communications Commission published its final rule implementing the Junk Fax Prevention Act and the important "established business relationship" exemption to it. Businesses using faxes to communicate with customers will be pleased to learn that FCC upheld the exemption to the general prohibition on junk fax when there is an established business relationship (ERB). The exemption does not include a time limit on the ERB. The sender of the fax has a duty to prove that an ERB existed but no specific recordkeeping requirements were made. The recipient's fax number must have been obtained in the context of an ERB, including those obtained from the recipient's own directory, advertisement or internet site unless the recipient posts a notice stating otherwise. Senders may also use third-party directories if they can take reasonable steps to show the recipient consented. Any faxes sent under an ERB must be related to the products and services of the sender. The FCC regulations require an opt out notice on the first page of the fax so the recipient can decline to receive future faxes. Senders need provide only one type of opt out mechanism among which can include a website, email adress, toll-free telephone number or toll-free fax number. However, the opt out mechanism chosen must be available 24/7 and the request must be honored as soon as possible but no longer than 30 days after the request was made. The FCC declined to exempt small businesses and trade associations from providing cost-free opt out mechanisms.
